Policies

General Policy
THIS SHORT TERM RENTAL AGREEMENT ("Agreement") executed this (Reservation.BookedOn) by and between Exceptional Stays, Inc. ("Rental Agent") and (Guest.FullName) ("Guest") for the short term rental at the real property located at: (Property.Address). ("Property")The property contains (Property.Bedrooms) bedrooms and (Property.Bathrooms) bathrooms. 1.TERM.The Property shall only be occupied as an immediate short-term vacation domicile for the term commencing on, (Reservation.Arrival) at 4:00PM ("Commencement Date") and terminating on, (Reservation.Departure) at 10:00 AM ("Rental Period"). 1.1 Check-In/Check-Out Time. Check-in time is 4:00 PM. Check-out time is 10:00 AM. Early or late arrivals and departures may be arranged with the Rental Agent in advance. Any unauthorized check-outs between 1:00 PM and 6:00 PM. will be charged a fee equal to 50% of one night’s rental fee which shall be charged to the Guest’s credit card. Unauthorized check-outs after 6:00 PM will be deemed “hold-overs” and charged a fee equal to 150% of one night’s rental fee which will be charged to the Guest’s credit card. Unauthorized early check-ins are deemed to be a trespass and may be subject to the cancellation of the reservation and forfeiture of all deposits paid hereunder and/or charged a fee equal to 200% of one night’s rental fee which will be charged to the Guest’s credit card. If Guests need to check in earlier than 4:00 PM or check out after 10:00 AM, the Guest must receive prior approval from the Rental Agent. 1.2 Delay in Tender of Possession. Although Agent will make every effort to have the Premises ready for Guest’s occupancy at the beginning of the term of the Rental, it may not be possible to do so for reasons beyond Agents control (such as where a prior guest has not vacated the Premises at the expiration of term of such other guest’s rental). If Agent cannot deliver possession of the Premises when required to under this Agreement, Agent shall promptly refund to Guest the Rent for the applicable period during which the Premises are not available to Guest. 2. PREMISES. Agent agrees to lease to Guest, Guest shall lease from Agent, the Property known as (Property.Alias) located at (Property.Address), located in (Area.City). Areas excluded include: caretaker buildings, any secured storage areas, mechanical or work areas. 3. RENTAL FEE. The total fees for the Rental, including rent, taxes, resort fee, cleaning fees (if any) and the optional Damage Insurance for the Rental Period is (Reservation.Total) ("Total Fees"). 3.1 Initial Deposit. An initial deposit in an amount equal to 50% of the Rent and taxes and the 6% resort fee (“Initial Deposit”) shall be due at time of booking and execution of this Agreement. If the Initial Deposit is NOT received by FIVE DAYS AFTER (Reservation.BookedOn) , this Agreement shall terminate at the sole option of Rental Agent. SUBJECT TO SECTION 4 BELOW, THE INITIAL DEPOSIT SHALL BE NONREFUNDABLE. 3.2 Final Deposit. A final deposit in an amount equal to the remaining balance of the Total Fees ("Final Deposit") shall be due no later than sixty (60) days before the Commencement Date (“Final Deposit Due Date”). THE FINAL DEPOSIT SHALL BE NONREFUNDABLE. THE FINAL DEPOSIT DUE DATE IS SIXTY DAYS BEFORE (Reservation.Arrival). (“Final Deposit Due Date”). 3.3 If this Agreement has not been cancelled by Guest in accordance with Section 4 below by the Final Deposit Due Date, the Final Deposit shall be due and owing from the Guest and the Rental Agent shall automatically process the Final Deposit and shall be authorized to charge the Guest’s credit card for the total Final Deposit. Guest shall provide Rental Agent with a credit card number that the Rental Agent is authorized to process payment for the Final Deposit in the event that the Rental Agent has not received the Final Deposit by the Final Deposit Due Date, plus a 3.5% credit card processing fee. 3.4 Default. If Guest shall fail to pay any deposit, rent or cos
Written Cancellation Policy
Deposit refunds are available if a reservation is cancelled prior to 30 days before the arrival date. The entire deposit shall be refundable, less the first night's rent/tax, resort fee/tax and 6% booking fee. No refunds will be available for reservations cancelled within the 60 days prior to arrival. For reservations of 30 nights or longer, the entire first deposit shall be non-refundable upon booking.
Written Deposit Policy
50% of rent/tax, plus a 6% non-refundable resort fee/tax and a $59 damage waiver are all due at booking and will be charged to your credit card at that time. For reservations made less than 60 days prior to the arrival date, the deposit becomes 100% (i.e. the entire rental fee is due and payable at the time of booking). The balance of all remaining rental fees is due and payable 60 days prior to the arrival date. The original credit card used at the time of booking will be charged for the balance unless other arrangements have been made prior to that time. Failure to remit the balance due without explicitly canceling a reservation will cause Renter to forfeit the deposit.
Check In
Check-in time is after 4:00 pm on the arrival date. Approximately ten days before your arrival date, you will receive an information packet by email that contains check-in procedures.
Check Out
Check-out time is 10:00 am on the departure date. Please leave single key in lock-box upon departure.
